Terms of Service for ScaffWorks Scaffolding Industry LLC - WhatsApp Integration

1. Acceptance of Terms

By interacting with ScaffWorks Scaffolding Industry LLC ("ScaffWorks," "we," "us," or "our") through our WhatsApp integration, you ("you" or "user") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our WhatsApp integration.

2. Description of Service

Our WhatsApp integration allows you to communicate with ScaffWorks regarding our scaffolding products and services, including inquiries, customer support, order placement, and other related matters.

3. User Conduct

By using our WhatsApp integration, you agree to the following:

  • You will use the service only for lawful purposes and in a manner consistent with these Terms of Service and any applicable laws and regulations.
  • You will not use the service to transmit any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
  • You will not impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • You will not send unsolicited messages or spam through the service.
  • You acknowledge that the information you share may be stored and processed as described in our Privacy Policy.

While we strive to provide accurate and timely information, ScaffWorks does not guarantee the accuracy, completeness, or usefulness of any information provided through the WhatsApp integration. Our responses are for informational purposes and should not be considered professional advice.  

5. Third-Party Services (WhatsApp)  

You understand and agree that your use of our WhatsApp integration involves the use of third-party services provided by Meta Platforms, Inc. (WhatsApp). ScaffWorks is not responsible for the performance or availability of WhatsApp's services.

6. Intellectual Property

All content provided by ScaffWorks through the WhatsApp integration, including text, graphics, logos, and other materials, is owned by or licensed to ScaffWorks and is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or otherwise use our content without our prior written consent.

7. Disclaimer of Warranties

THE WHATSAPP INTEGRATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SCAFFWORKS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCAFFWORKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE WHATSAPP INTEGRATION, EVEN IF SCAFFWORKS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OF SERVICE OR THE WHATSAPP INTEGRATION SHALL NOT EXCEED [Specify a nominal amount, e.g., AED 100].  

9. Indemnification

You agree to indemnify, defend, and hold harmless ScaffWorks and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the WhatsApp integration or your breach of these Terms of Service.  

10. Termination

We may terminate or suspend your access to our WhatsApp integration at any time, with or without cause and without prior notice.  

11. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the United Arab Emirates, specifically the laws of [Specify the Emirate, e.g., Dubai].
